These Terms of Service (“Terms”) govern your use of the Climate Control Warehouse website and any purchase made through it. By using this website or placing an order, you agree to these Terms.

Our Standard Climate Control Warehouse (Pty) Ltd Terms & Conditions of Sale also apply to all orders. Where there is a conflict, the Standard Terms & Conditions of Sale prevail in respect of the sale of goods.

Using this website
You agree not to:

• Use the website for any unlawful purpose
• Attempt to gain unauthorised access to any part of the website or its systems
• Introduce malicious code, or interfere with the website’s operation
• Copy, scrape, or reproduce website content for commercial purposes without our written permission
• Misrepresent your identity or your authority to bind a business

We may suspend or terminate your access where these Terms are breached.

Product information
We take care to describe our products accurately using information supplied by manufacturers. However:

• Product images are for illustration and may differ from the actual product supplied.
• Technical specifications are supplied by the manufacturer and are subject to change without notice.
• Specifications in catalogues and on this website are indicative. Confirm critical specifications with your sales representative before ordering.
• Colour reproduction varies between screens.

Pricing

• All prices displayed on this website include VAT at 15% unless expressly stated otherwise.
• Prices exclude delivery unless expressly stated otherwise.
• Prices are subject to alteration without prior notice.
• Where a dealer discount applies, it is reflected in the price shown to your account.
• Quotations are valid for 30 days from date of issue.

Despite our best efforts, pricing errors can occur. Where a product’s correct price differs materially from the price displayed, we will contact you before dispatch and you may confirm the order at the corrected price or cancel it for a full refund.

Orders and acceptance
Your order is an offer to purchase. A contract is formed only when we confirm acceptance of your order in writing or dispatch the goods, whichever occurs first. We reserve the right to decline any order.

Stock is normally available ex-stock but is subject to prior sale. Rooftop and chiller units are typically supplied to order.

Payment

• Payment is processed through PayFast, which accepts card and EFT payment methods.
• Goods are dispatched only once payment reflects in our bank account, or where an approved account holder has sufficient credit available and the account is in good standing.
• We reserve the right to suspend dispatch on accounts that are overdue or exceed their credit limit.

Ownership and risk
Risk in the goods passes to you on delivery. Ownership of all goods remains with Climate Control Warehouse (Pty) Ltd until payment has been received in full.

Installation and compliance
Products supplied by CCW are equipment only. Installation is not included unless expressly quoted.

It remains the responsibility of the client and the installer to:

• Ensure installation is carried out by a suitably qualified and registered installer
• Comply with SANS 10142-1 (Wiring of Premises), applicable SANS standards, and all local municipal by-laws
• Obtain a Certificate of Compliance where a new electrical circuit is installed
• Verify cabling requirements. Certain imported units are supplied with an interlinking cable, but SANS and local municipal regulations may require Norse or Surfix cabling for interlinking

CCW accepts no liability for loss, damage, injury, or warranty invalidation arising from non-compliant installation.

Warranties
Products carry the warranty offered by the relevant manufacturer. Warranty terms, periods, and exclusions vary by brand and model and are set out in the documentation supplied with the product. See our Return and Refund Policy for how to lodge a claim.

Limitation of liability
To the maximum extent permitted by law, and subject always to your rights under the Consumer Protection Act:

• Our total liability arising from any order is limited to the invoice value of the goods giving rise to the claim.
• We are not liable for indirect, consequential, or economic loss, including loss of profit, loss of business, or loss of data.
• We are not liable for delays or failures caused by events beyond our reasonable control.

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded.

Intellectual property
All content on this website, including text, images, logos, product photography, catalogues, and layout, is owned by CCW or its suppliers and is protected by copyright and trade mark law. Brand names and logos (including Haier, Kwikot, YORK, Thermocold, and Airwave) are the property of their respective owners.

Governing law
These Terms are governed by the laws of the Republic of South Africa. The parties consent to the jurisdiction of a South African court of competent jurisdiction in respect of any dispute arising from these Terms.

Changes to these Terms
We may amend these Terms at any time. The version in force at the time of your order applies to that order.
